Terms of Service

1. About these terms

These terms are an agreement between you and [Company legal name], Külbstr. 20, 55131 Mainz, Germany ("we", "us"). By creating an account you accept them. Our Privacy Policy explains how we handle your data.

2. What Last Seen does - and does not do

Last Seen lets you check in on a schedule you set. If you miss a check-in, it reminds you; if you still do not respond, it can alert the people you have chosen. It also lets you leave a final note that can be released to your circle under strict conditions.

Last Seen is not an emergency service. It does not contact the police, ambulance or any authority, does not monitor your health or location, and is not a medical device. Reminders and alerts depend on things outside our control - your device, its battery and notification settings, mobile networks, and third-party providers - and may be delayed or fail. If you or someone else may be in danger, call your local emergency number.

3. Who can use it

You must be at least 16 years old. If you are under 18 and live somewhere that requires a parent or guardian's permission to use apps like this, you need that permission. You may not use Last Seen where the law does not allow it.

4. Your account

Your account is tied to your device. Keep your device locked and secure. If you verify a phone number or email, you can use it to recover your account on a new device; if you do not, losing your device means losing access to your account. Each account is for one person.

5. Your emergency contacts and circle

• Only add people who have agreed to be your emergency contact, and keep their details accurate.
• Tell them what to expect. We also send them a one-time notice with a way to opt out, and we respect their choice.
• The people you add are not our agents and have no duty to act. What they do after an alert is their own decision.
• Never add someone to annoy, harass or monitor them.

6. Watching someone

You may join someone's circle only with an invite they gave you. They can remove you at any time. Use what you see only to look out for their wellbeing - never to track, pressure or harm them.

7. Your final note

The note is your content and your responsibility. Do not put in it information you have no right to share. It is released only under the conditions in our Privacy Policy. If you forget your PIN, resetting it erases the note permanently and we cannot recover it for you.

8. Acceptable use

Do not use Last Seen to break the law; harass, threaten, stalk or impersonate anyone; send messages that are not about your wellbeing; interfere with or overload the service; get around its limits or security; or copy, resell or reverse-engineer it except where the law allows.

9. Messages and SMS

Reminders and alerts are service messages, not marketing. How often they are sent depends on your schedule. Standard message and data rates may apply. Recipients can reply STOP to stop texts and HELP for help, or contact support@lastseen.help.

10. Price

Last Seen is currently free. If we introduce paid features, we will show the price clearly and ask for your agreement before charging you, and you will keep any right to cancel that the law gives you.

11. Changes to the service

We work to keep Last Seen available but may need to pause it for maintenance, and we may improve or change features. If a change significantly reduces what you get, we will tell you in advance, and you can export your data and close your account.

12. Ending your use

You can stop using Last Seen and delete your account at any time in Settings.

We may suspend or close an account for a serious or repeated breach of these terms, to comply with the law, or to protect others. Unless the law or an urgent risk prevents it, we will tell you why first and give you a chance to respond and to export your data. You can challenge our decision by contacting legal@lastseen.help.

13. Intellectual property

The app and its content belong to us or our licensors. We give you a personal, non-transferable right to use it. Your content - including your final note and messages - stays yours; you give us permission to store, process and deliver it only to provide the service.

14. Our responsibility to you

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or any other liability that cannot be limited by law.

If you live in the EU, the EEA or the UK: you have legal rights if the service is not as described or does not work as it should, and these terms do not affect them. We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care, but not for loss that was not foreseeable.

Everywhere else, to the extent the law allows: the service is provided "as is"; we are not liable for indirect or consequential loss, or for loss caused by devices, networks, third-party providers, your settings, or the actions of people in your circle; and our total liability to you is limited to USD 100. Some places do not allow these limits, so they may not apply to you.

15. Disputes and governing law

Please contact us first at legal@lastseen.help - most problems can be solved quickly.

These terms are governed by the law of Germany. If you are a consumer, you also keep the protection of the mandatory laws of the country or state where you live, and you can bring a claim in your local courts. We do not require arbitration, and we do not ask you to waive class actions.

16. Changes to these terms

We will tell you in the app at least 30 days before material changes take effect, unless a change is needed sooner for legal or security reasons. We will ask you to accept the new terms; if you do not agree, you can delete your account before they apply.

17. App stores

If you downloaded Last Seen from the Apple App Store: these terms are between you and us, not Apple. Apple is not responsible for the app, its maintenance or support, or any claims relating to it, including product liability, legal compliance or intellectual property claims. If the app fails to conform to any applicable warranty, you may notify Apple for a refund of any price paid (currently none); to the extent the law allows, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. The Google Play and other store terms also apply to your use of those stores.

18. General

If part of these terms is found unenforceable, the rest still applies. If we do not enforce a right straight away, we can still do so later. We may transfer these terms to a successor who continues the service, and your rights will not be reduced. These terms are available in several languages; where the law gives you the right to rely on the version in your language, you may.
